- ELIGIBILITY: The All Kinds of ThanksWinning Giveaway (referred hereafter as “Giveaway”) is open to legal residents of the 50 United States or the District of Columbia who are 18 years of age or older at time of entry. Employees of Butterball, LLC (“Sponsor”) and the Administrator and their immediate family members and/or household members of such persons are not eligible to participate or win. Void where prohibited by law.
“Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three (3) months a year, whether related or not.
By participating, you (“Entrant” or “You”) agree to abide by and be bound by these Official Rules, and the decisions of Sponsor and its agents are final and binding in all respects. Giveaway is subject to all federal, state and local laws.
- How to Enter: You may enter the Giveaway once during the entry period starting at 12:00 am Eastern Time (“ET”) on November 1, 2019 and ending at 11:59 pm ET on November 18, 2019 (the “Giveaway Entry Period”). To enter, visit ButterballThanksWinning.com (“Website”) during the Giveaway Entry Period and follow all online instructions to complete and submit the Giveaway entry form (referred herein as “Entry”). Part way through the Giveaway Entry Period, daily drawings for prizes will commence – so enter early! Each eligible Entry received during the Giveaway Entry Period will be entered into the first Daily Prize random drawing for which it qualifies, and if not drawn as a winner at that time, will be carried over into subsequent Daily Prize random drawings for an opportunity to win a Daily Prize. A total of 11 Daily Prize random drawings will be held, each held on or about the next business day following the applicable cutoff time below for eligible Entries received prior to such time.

All eligible Entries received at any time during the Giveaway Entry Period will automatically be entered into separate drawings for the Grand Prize, First Prizes and Second Prizes regardless of whether the Entry is also drawn as a Daily Prize winner. Limit one (1) Entry into the Giveaway per person during the Giveaway Period. Limit one (1) Daily Prize and one (1) other prize per person in the Giveaway. Any attempted participation beyond this limit or multiple Entries received from any person (including, without limitation, by providing multiple sets of false contact information or submitting multiple email addresses) are void and he/she may be disqualified in Sponsor’s sole discretion. Multiple Entrants are not allowed to share the same email address. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. If a dispute arises regarding the identity of an Entrant or Entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible. All Entries become the property of Sponsor and will not be acknowledged or returned. Other offers not related to the Giveaway may be presented on the Website, so be sure to follow the instructions to enter the Giveaway.
Sponsor’s computer system shall be the official timekeeper of the Giveaway. Internet access charges imposed by your on-line service provider may apply. If you enter using a mobile device, standard data rates may apply from your wireless carrier.
Entrants who have not complied with these Official Rules are subject to disqualification and their Entry will be void. Sponsor or Administrator reserves the right to disqualify any Entrant’s Entry in the Giveaway if Sponsor or Administrator determines or suspects that the Entrant has attempted to undermine the legitimate operation of the Giveaway by cheating, hacking, deceptive, using unfair playing practices or entering robotic submissions or otherwise violating these Official Rules. Sponsor reserves the right to cancel, modify, or suspend the Giveaway at any time if fraud, technical failures, any unanticipated occurrence that is not fully addressed in these Official Rules or any other errors or other causes corrupt the administration, security, integrity, or proper play of the Giveaway. In the event of cancellation, Sponsor reserves the right to select the winners from among all eligible Entries received up to the time of such cancellation, in a manner determined by Sponsor to be fair, appropriate, and consistent with these Official Rules. Notice of any such cancellation, modification or suspension will be posted on the Website.
Should Entrants choose to share any post on social media relating to this Giveaway, such sharing does not affect the odds of winning a prize in this Giveaway or result in any additional Entry in the Giveaway.
- WINNER SELECTION AND NOTIFICATION: Daily Prize random drawings of 500 winners in each drawing will be conducted on or about the next business day following the timeframes shown under “How to Enter” above. Daily Prizes will be delivered to the winners of such prize at the address used to enter, with the delivery itself comprising notice of their having won. Grand Prize, First Prize and Second Prize (collectively referred as “Ultimate Prize”) random drawings of one (1) Grand Prize winner, two (2) First Prize winners, and four (4) Second Prize winners will be conducted on or about the next business day following the closing of the Giveaway Entry Period. All potential winners of an Ultimate Prize will be notified by email at the email address used to enter the Giveaway. All drawings will be conducted at random under the supervision of the Administrator.
As a condition to claiming an Ultimate Prize, each potential Ultimate Prize winner will be required to complete and return a signed and notarized Affidavit of Eligibility/Liability and a Publicity Release and a signed IRS Form W-9 (Request for Taxpayer Identification) (collectively, the “Affidavit”) within seven (7) days as directed. If the Affidavit is not returned completed within the date specified or if an Affidavit or prize notification is returned as undeliverable, or if a potential prize winner is otherwise found to be ineligible, or if a potential prize winner cannot accept/receive the prize for any reason, of if a potential winner fails to comply with these Official Rules, that potential winner will be disqualified and the corresponding prize will be awarded to an alternate winner. Attempts will be made to contact and/or verify up to at least five (5) alternate Ultimate Prize winners. After five (5) attempts to verify a winner for the unfulfilled Ultimate Prize fails, the prize may not be awarded. All Ultimate Prize winners will be required to furnish his/her Social Security Number to the Sponsor and/or Administrator on the IRS Form W-9 and an IRS Form 1099 will be filed in the name of the winner for the prize value awarded. Any attempts to circumvent eligibility requirements to improperly claim a prize are actionable to the full extent permitted by law. Ultimate Prize winners may confirm their address for delivery in connection with completing the Affidavit. Delivery of some Ultimate Prize components could take up to 6 to 8 weeks after Affidavits have been received and winners have been verified.
Sponsor is not responsible for any change of mailing address and/or contact information of any Entrants during the course of the Giveaway or period when prizes are being fulfilled. Sponsor is not responsible for any returned/undeliverable prizes, delays in prize delivery caused by the delivery carrier, or unclaimed prizes or prize components. Returned, undeliverable, or unclaimed prizes or prize components will be forfeited.
- PRIZES:
• 5,500 Daily Prizes: Each Daily Prize winner will receive a $20 reward card, which may be used toward the purchase of a frozen Butterball turkey or otherwise in the winner’s discretion. Approximate retail value (“ARV”) of each reward card: $20. A total of 5,500 Daily Prizes will be available to be awarded in this Giveaway (with 500 Daily Prizes available for each of the 11 drawings for such prizes). No substitution allowed except, at Sponsor’s sole discretion, a prize of comparable value may be substituted. Reward card is not redeemable for cash.

Grand Prize, First Prize and Second Prize Winners can elect to receive cash in the amount of the maximum stated ARV of their prize in lieu of the prize items as described above. If this option is elected, it must be communicated to Sponsor not later than when the winner is merely a potential winner completing the Affidavit described above. Electing to receive cash in lieu of the prize items, or vice versa, has no bearing on whether a potential winner becomes a confirmed winner or is eligible to win. Cash will be awarded in the form of a corporate check to an address specifically directed by the winner in writing.
Use of any reward card, gift card, or prepaid debit card is subject to the issuer’s terms and conditions notified on the card itself or on its wrapper or packaging. All of the cards may have expiration dates. Check the terms of the $20 reward card, Visa® prepaid debit card and Flower.com gift card to see whether they may expire or incur inactivity fees. The issuer of each card sets the terms for each specific card. Reward cards, gift cards and prepaid debit cards will not be replaced if expired, lost, stolen or damaged and are not redeemable for cash.
All prize items selection such as models, size and colors are at the Sponsor’s discretion. Prize elements may not be separated. If winner is not able to accept any portion of the prize due to any reason, he/she will not receive an alternate prize. Sponsor reserves the right, in its sole discretion, to substitute a prize or portion of a prize with a prize of comparable value in the event the stated prize or prize component becomes unavailable for any reason. Otherwise, no prize substitutions are allowed. All winners acknowledge that the Giveaway Entities and their agents do not make, nor are in any manner responsible for, any warranty or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any prize. Prize is awarded as is or winner forfeits all rights to prize. Prize images depicted in advertising and promotional materials may vary from the actual prize as any depiction of prize is for illustrative purposes only. The trademarks associated with prizes are the property of their respective owners, who are not affiliated with this Giveaway in any fashion whatsoever, and no endorsement is suggested or implied.
All federal, state, and local taxes (including income and withholding taxes), if any, as well as any other costs and expenses associated with claiming or using a prize and not specifically mentioned herein are not included within any prize and are solely each winner’s responsibility.
Total ARV of all prizes: up to $160,000. Limit: one (1) Daily Prize and one (1) Ultimate Prize per person in the Giveaway. Odds of winning a Daily Prize depend upon the total eligible Entries received prior to a given Daily Prize random drawing (keeping in mind that Entries not drawn as a potential Daily Prize winner carry over to subsequent drawings for such prizes). Odds of winning an Ultimate Prize depend upon the total eligible Entries received during the entire Giveaway Entry Period (regardless of whether the Entry is also drawn as a Daily Prize winner).
- LIMITS ON LIABILITY: By entering, you (i) agree to be bound by these Official Rules, including all eligibility requirements; (ii) agree to be bound by the decisions of Sponsor and the Administrator, which are final and binding in all matters relating to the Giveaway; and (iii) release, hold harmless, and indemnify Sponsor and its affiliated companies, the Administrator and all other businesses involved in this Giveaway, as well as the employees, officers, directors and agents of (the “Giveaway Entities”), from, and hereby waive any claims to, all claims, losses, injury, damages, and liability of any kind to person(s), including death, or property damage arising directly or indirectly or relating to your acceptance, possession, use and/or misuse of a prize, and participation in the Giveaway, including privacy or right of publicity claims or claims related to merchandise delivery.
Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” Entrant acknowledges that the releases herein are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of such laws to preserve future unknown claims.
The Giveaway Entities do not warrant that access to the Giveaway will be uninterrupted and are not responsible for: (a) Entries from persons residing, or physically located, outside the eligible States mentioned in section 1 above; (b) Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Official Rules; (c) lost, interrupted or unavailable networks, servers, satellites, or other connection, availability, or accessibility problems arising in connection with or over the course of the Giveaway; (d) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, clerical, typographical or other errors in connection with the administration of the Giveaway, the processing of Entries, or the offering or announcement of the prizes or in any prize notification documents; (e) any other errors of any kind relating to or in connection with the Giveaway, whether human, mechanical, clerical, electronic, or technical in nature; (f) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Giveaway, or (g) damage to a user’s system occasioned by participation in this Giveaway or downloading any information necessary to participate in this Giveaway; even if caused by the negligence of any of the Giveaway Entities.
ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR OR ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL, TO THE FULLEST EXTENT PERMITTED BY LAW.
- PUBLICITY: Sponsor and/or its respective agents may film, record and/or take photographs before/during/after any prize award session and may use the resulting footage, recordings or photographs for a range of purposes, including, without limitation, for marketing and promoting Sponsor’s respective products and services and in any and all media worldwide (including but not limited to social media and all internet platforms). Entry and acceptance of a prize constitute permission for Sponsor and its designees to use each winner’s name, prize won, hometown, videos, photos, testimonials and likeness for online posting and promotional purposes without further permission, compensation or notification to any winner, except if prohibited by law.
- DISPUTES: If any part of these Official Rules is deemed to be invalid or otherwise unenforceable or illegal, the balance of the Official Rules shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Except where prohibited, Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a federal or state court located in Wake County, North Carolina.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (c) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
- PRIVACY: By participating in this Giveaway, you acknowledge and agree that your personal information supplied to Sponsor may be used by Sponsor for internal marketing purposes. Information provided by you will be treated consistent with Sponsor’s privacy policy, which is located at https://www.butterball.com/privacy-policy. The Administrator will also have access to your personal information for purposes of administering this Giveaway.
